Anti-Spam (CASL) Policy

Purpose

The Job Shoppe realizes that education and awareness are the keys to ensuring appropriate steps are taken to combat spam and makes sure that the necessary parties in the organization become aware of Canadian Anti-Spam Legislation (CASL) and the various rules and regulations that the legislation outlines.

Scope

This policy applies to all employees of The Job Shoppe, including management, employees, and any external contractors involved in email communications. It covers all forms of electronic communication, including emails, newsletters, and promotional messages sent on behalf of the organization. Additionally, it encompasses all activities related to the collection, use, and dissemination of personal information as it pertains to Canadian Anti-Spam Legislation (CASL).

Policy

The Job Shoppe understands the goal of the anti-spam legislation in Canada is to deter damaging and misleading forms of spam. In doing so, the company acts in accordance with Canada’s Anti-Spam Legislation (CASL). The company therefore:

  • Uses and observes the limits of commercial electronic messages (CEMs);
  • Produces or installs computer programs in support and recognition thereof; and
  • Is involved with the alteration of transmission data.

Commercial Electronic Messages (CEMs) 

Commercial electronic messages (including email marketing) are based on a consumer opt-in approach. The Job Shoppe obtains consent to send CEMs before sending them, unless the organization has an existing business or non-business relationship with the recipient, in which case, consent is considered to be implied.

The Job Shoppe ensures the practices below are followed when using electronic messaging for marketing purposes:

  • Outline Purpose: Determine generally how CASL applies to the company’s operations, advertising, IT, and marketing activities particularly. some text
    • Create a comprehensive list of categories of CEMs sent out by the company, whether it’s promotional, informational, or related to a service inquiry.
    • Create standardized templates that CEMs must use. Each template includes the mandatory identity and contact information, along with a compliant unsubscribe mechanism.
  • Type of Consent: Create a comprehensive inventory of all current contact lists to determine whether consent is express, implied, or a CASL exception applies. This list is updated regularly. The company upgrades any implied consent to express consent before the two-year anniversary of a transaction unless the recipient unsubscribes.
  • Unsubscribe Mechanism: Every CEM will have an easy-to-use and visible option to unsubscribe from further communications. This feature will be simple to access and will process unsubscribe requests promptly.
  • Record-Keeping: some text
    • Maintain a list of recipients, whether express or implied, verifying their consent. If consent is written, the company records when, why, and how it was obtained. If consent is oral, the company retains a complete and unedited audio recording or determines a means of verifying with an independent third party.
    • Track and manage unsubscribe requests in compliance with CASL regulations.
  • Train Staff: Train necessary members of the organization about CASL and implement standard operating processes for compliance.
  • Compliance: Practice due diligence while establishing procedures for monitoring the organization’s compliance and responding to violations.

Installation of Computer Programs

The Job Shoppe complies with the requirements of CASL for the installation of computer programs on another person’s computer in the course of commercial activity.

To install or direct the installation of a computer program, The Job Shoppe receives express consent before installation, following all guidelines that apply. 

Express consent applies to circumstances where the individual accepts a program that is a cookie, HTML code, Java scripts, an operating system, or any other program executable through the use of another computer or program with the installation or use thereof having been expressly consented to, or any other program specified in the regulations.

Alteration of Transmission Data

The Job Shoppe does not participate in the unauthorized alteration of transmission data. Unless express consent has been received, no technical measures are ever used to redirect or deliver a message to a destination other than or in addition to the one specified by the sender.

Privacy and Security

The Job Shoppe ensures that all personal information collected for the use of business operations is safeguarded and stored in accordance with the company’s obligations under CASL and any appropriate privacy legislation.

The company does not release, distribute, sell, share, or take any actions with the personal information it obtains for business operations without the express consent of the individual.

The company takes all reasonable measures to ensure that its software, computer systems, and all other devices have security measures in place to reduce the risk of hacking, phishing, viruses, or other issues where there is a risk of the release of personal information. All employees must report any attempts or suspected attempts of breach to company devices, resources, systems, to The Job Shoppe’s President & C.E.O. immediately.

Miscellaneous 

The Job Shoppe, or its employees or representatives, do not aid, induce, procure, or cause to be procured any acts that contravene this policy or CASL. All employees must adhere to this policy and report any suspicious or verified conduct that contravenes this policy or CASL to The Job Shoppe’s President & C.E.O.

Fraudulent or malicious reports of contravention are not tolerated and, if determined that the report was fraudulent or malicious, the employee is subject to progressive discipline procedures, up to and including termination of employment.
